The Facts About Underground Storage Tanks
However, If you own or operate a non-residential heating oil underground storage tank (UST) greater than 2,000 gallons, this is something you need to know.
A new law extends the underground storage tank compliance deadline to December 22, 2003 for commercial heating oil tanks.
Previously, NJ law mandated that all regulated tanks be equipped with Stpill, Overfill, and Corrosion Protection by December 22, 1998. But new legislation may qualify you for an extension.
To be eligible for the extension, you must:
  • Have your tank undergo a tightness test by 12/22/98 and forward the results to the DEP. (Note: If you had a tank tightness test performed since 1/1/98, you can qualify, but must forward the results to the DEP prior ro 12/22/98) or,
  • Have a contract in place by 12/22/98 that stipulates your tank will undergo such a test by 8/31/99 and submit a copy of the testing contract to the DEP by 12/22/98. Mail to:

    In addition, you must:
    • Notify the DEP within 15 days of performance of the test;
    • Perform a tightness test every three years thereafter;

After a tightness test of your tank has been performed and it has passed, you have an extension of a period of five years within which time you must upgrade your tank system to include the Spill, Overfill, and Corrosion Protection requirment.
